No. 

FuriousFotog™ Image Licenses are indefinite and do not expire. They are also global and do not expire after exceeding a certain number of sales.


NOTE: Some publishers may have their own contracts with different terms; these are reviewed and handled on a case-by-case basis.

Yes. 

FuriousFotog™ Image Licenses cover ebooks, physical copies, and audiobook editions of a book. You can also use the Image in any promotional manner, including but not limited to swag, teasers, banners, free cups or other merchandise.

If you wish to use the same Image on a second book cover, there is an additional $200 fee.

If you wish to use the same Image on more than two covers, there is an additional $100 fee for each cover after the second.

If you wish to use the Image on a product that you will sell for profit, you must pay an additional fee of $300 for an Extended License, per Image, per Product.

Licenses are non-transferrable and non-sublicensable without express written permission and oversight from the Photographer.

You are buying the exclusive right to use an Image for commercial use on the cover of a book cover. This covers all forms of the Work, including ebook, physical copies, and audiobooks for an indefinite amount of time, globally, and without sales restrictions.

For a standard FuriousFotog™ Image License, the price is a sum total of both a Photographer Fee ($300) plus a Talent Fee. A quick reference PDF is available in the Book Cover Information Center.

A Talent Fee is an independently determined rate that a model or their management/agency requires for use of their Image in a commercial manner (as granted by the License). This fee begins at $300 for Furious Models, but may be higher or lower as set by freelance models or agencies.

Under $600, A: $600, B:$650, C: $675, D: $700, E: $750, F: $800-$999.  No single exclusive image is over $1000!

Yes.

Payment plans are offered via a PayPal invoice that can be paid on at your leisure. The initial $150 deposit is nonrefundable. Invoices carry a 4-month term. Once past due, entire amount of the invoice is nonrefundable and Agreement is subject to termination.

If you wish to use the purchased Image(s) for multiple book covers (eg a duet or two titles, trilogy, etc) or for any commercial sales of products (such as a calendar, mugs, etc.) there is an additional fee assessed in the License Agreement / on the invoice.

Exclusivity & Copyright

So the same Image is not re-sold to another person after I buy it, right?

Images are exclusive, so the same shot from the same set will not be resold.

Exclusive in this case means just that; the Image you purchase from a set will not be sold to another Licensee for use on a book cover.

Yes. 

Standard FuriousFotog™ Image Licenses grant exclusivity to the particular shot that is purchased from a single set (see more at the Exclusivity link below). Other (different) Images in the same set, in the same outfit, or at the same location will still available for sale. 


Note: the same pose may appear in multiple sets and be available for purchase by others (e.g. shirtless with an arm up in the studio vs. on location).

No. 

The License grants use of the Image to the Licensee, but not full copyright. Furious Fotog retains full copyrights and can use the Image for their own projects/promotion (such as selling prints) in a manner that will not infringe upon the rights granted to the Licensee.

Yes.

The Image background can be adjusted from its default black to any color or gradient at no charge. See other questions for anything that goes beyond this single color change.

Yes.

The Image may be modified by you or your designer in any way for your cover. For example:  changing hair and eye color, adding or removing tattoos, changing backgrounds to include other things like a cityscape, etc. As long as the end result does not defame the model or Furious Fotog, you're okay.


NOTE: Furious Fotog is only responsible for the integrity of the original Image that is sold from a set. FuriousFotog is not responsible for the resulting design that is created by the Licensee and/or a cover designer (i.e. cropping, editing, styling, etc.), even if the poses from different sets are the same.

Yes, but with a cost. 

The Image may be modified by Furious Fotog instead of a cover designer but this will incur an additional editing service fee (typically $75 for artistic edits and $150 per design). Normally, custom cover design happens over the months of November to January (due to busy spring to fall travel). 


NOTE: FuriousFotog will NOT design or change an image to look like someone else's cover design or edit the photo to look like an Image that was already sold.

Yes, with an important restriction.
You can use Images for covering any genre of book, including romance and erotica, including diverse stories with diverse characters. This is covered by the License Agreement and model releases.


There is a restriction on use for book covers wherein the characters perform lewd acts as a main element of the plot (such as but not limited to being a pedophile, having sex with a minor, or necrophilia). Additionally, the design shall not defame the model or Furious Fotog.

Yes, but there is a time limit.

You are allowed to change your selection for a replacement Image one time per active contract within its first 45 days. Once paid in full and/or the high resolution Image delivered, there is no ability to exchange.


NOTE: Some models have higher or lower Talent Fees which may change the overall price of the License if you change.

When a Licensee selects a photo, it is taken off the market and others cannot buy it. Limiting the number of changes and the time in which it can be exchanged also limits the number of Images that are potentially tied up in the administrative process (which can cause the Image to miss a sale or remain unsold).

No.
Final edited images are delivered at full resolution and without watermarks only when paid in full and no sooner. If you want to run ad tests using one or more FuriousFotog images, you would need to purchase each one.

Similarly, because images are available for licensing until officially sold, watermarked proofs cannot be used for running test ads or any other commercial purposes.

Yes, but with limitations.

Licensees are able to cancel their License at any time when making payments. The amount paid will be refunded, less the $150 nonrefundable downpayment. No refunds are given once paid in full, the invoice goes overdue, and/or the high resolution Image has been delivered.

Similarly to Image Replacements, when a Licensee selects a photo, it is taken off the market and others cannot buy it. Depending on the amount of time or popularity of the Image, there may have been missed sale opportunities (other clients turned away, etc.). This deposit ensures FuriousFotog is able to maintain a minimum bottom line.

The views and opinions expressed by any model, the model's manager/agency, or any other clients, subcontractors, and/or vendors are those of the individual and do not necessarily reflect the official views, opinions, policy, or position of the FuriousFotog™ brand.  Per the contract, cancelations or refunds cannot be made solely on instances of such.

The images in the galleries are unedited proofs at low resolution (900 pixels on the longest side) to prevent theft. The images on social media are final edited versions (still at a low resolution of 1200 pixels). Files delivered to clients are at least 7000 pixels at 300 dpi.

Unfortunately, use of images in this manner constitues commercial use and therefore requires a licensing fee be paid beforehand. Marketing, regardless of industry, is affected by many different sources (image, copy, landing page, etc.).

The only restriction is the image cannot have any client branding added to it (that'd be commercial use and also imply that it's been purchased).

Use of images in this manner constitues commercial use and therefore must be licensed.


Please do not add any client branding directly onto images, even for fun games like "This or That", "Which drink are you?", etc. You can use the images for these games without any client branding and leaving the watermarks intact.

At least before final payment is made. 


Watermarks are a simple but effective defense against intellectual property theft. While you may have good intentions, someone seeing the image (however you use it), may be looking for a freebie.


It should also go without saying but please do not edit out watermarks. That constitutes IP theft.

This is a photo that is requested prior to an already scheduled photo shoot. This look (outfit and pose) would be licensed to the Licensee just as any other photo under a standard FuriousFotog Image License. Other shots in the same outfit would still be available for others to purchase in this case. (See Package A and B  for more information.)

This is a photo shoot that is scheduled specifically for the Licensee. As such, the Licensee has exclusive access to those photos and none will be available for sale to others. This service is priced at Photographer's rate of  $450-$500 (see Package C and D for more information).

Talent is scheduled and paid independently. Normally, Licensees have someone in mind and have made initial arrangements with them before contacting FuriousFotog.

In addition to the session fee for a full custom shoot ($450-$500), travel costs, lodging costs, and M&IE (Per Diem) are the responsibility of the Licensee.
