Detailed Image Licensing Information

FuriousFotog utilizes Rights Managed Image Licensing for its beautiful and unique images.

This helps to prevent repeated use of these images in multiple applications, such as on different book covers, avoiding brand dilution and most importantly making the image YOURS. 

PACKAGE A, EXISTING IMAGE - $600+

$300 standard Photographer's fee + Talent/Agency fee

What is it?

Exclusive licensing of a single, existing, and available image for a trade/e-book cover. Duplicate images that are in the same pose are not sold to others. TOTAL price is shown in folder names.

What is included?

  • Exclusive license is for UNLIMITED sales over an UNLIMITED time for a single book cover in ALL global territories.
  • This license applies to ebook, paperback, and audiobook editions of a book and promotional teasers and swag.
  • Covers with black backgrounds can be changed to a lighter color if needed.
  • PAYMENT PLANS ARE AVAILABLE.  Minimum $150 nonrefundable downpayment is required, due in full after four (4) months. A contract can be canceled before it is paid in full, with payments other than the downpayment refundable. Once a sale is finalized and/or an Image is supplied, or an invoice goes overdue, there are no refunds.
  • Quantity deals are available for 3 or more purchases made at one time on a single Image License Agreement.
  • Consult Agreement or FAQs for other terms and conditions (such as cancelations, image exchanges, etc.)

What is not included?

  • Additional editing (such as the removal of standard background elements, recompositing, combining elements from separate photos, etc.) constitutes high-end retouching services and carries an extra charge, based on the extent of additional editing required.
  • If a duet or series will use the same image, a premium of $200 applies for the extra cover and $100 for each additional cover thereafter. For example, a trilogy or 3 separate books by the same pen name using the same $600 image would total $900 ($600 for Book 1, $200 for Book 2, and $100 for Book 3).
  • Ability to sell products (calendars, mugs, etc) featuring the image.

Other information:

  • Talent fees are derived by the model or their agency; FuriousFotog does not determine the talent fee, which may be higher or lower than the baseline $300 for Furious Models.
  • If there are multiple models in an image (such as a couple), a separate fee is applied for EACH model or a couples fee may have been worked out by the model team.
  • If the model or their agency has a different talent rate, that new (higher or lower) rate will be applied to the Agreement instead of the $300 FuriousFotog talent fee.
  • All photos delivered for a cover are per the Photographer's established style. It is up to the cover designer to make adjustments to the cover for your Derivative Work, unless previous arrangements have been made with FuriousFotog.

PACKAGE B, CUSTOM REQUEST - $600+

$300 standard Photographer's fee + Talent/Agency fee

This is the same pricing as found in Package A, but for a single, customized image that is shot during an already scheduled photo shoot.

  • For example, if Client needs "a pic of model with an MC vest on, looking menacingly at the camera with one hand in his pocket," we can shoot that Image for them and it will be billed at the Package A/B pricing. 
  • Note - other shots of the model will be available for other Clients to purchase, but not the specifically requested pose. That pose would belong exclusively to the requesting Client.

PACKAGE C, FULLY CUSTOM - $450

This price is for the Photographer's fee only

Price shown is just for Photographer's session fee.

  • Travel expenses, where applicable, are paid by Client in advance.  See below for more details.
  • Models are booked and paid separately by the Client for a fully custom shoot.

What is it?

A fully custom photo shoot is often for a single book cover, including several images for associated promotional teasers & swag.

What is included?

  • Exclusive license is for UNLIMITED sales over an UNLIMITED time.
  • Session and use fee for up to eight (8) final edited HD Images. These eight (8) can be used on a single book cover and for teasers.
  • You are allowed to create giveaways items and "swag" such as postcards, bookmarks, etc.
  • If multiple book covers are to be created from any of these Images, such as with a duet or trilogy, a discounted premium of $200 is due for the second cover and $100 for each additional cover thereafter.
  • For example, if the Images will appear on a trilogy, there would be an additional $300 due ($200 for the second book and $100 for the third book).
  • Standard "Furious" editing, including retouching, background extraction such as making black into white or gray.
  • Additional edits beyond the packaged eight (8) are available at $20 each, for promotional use only. Using any of these extra Images on a  new cover requires the discounted premiums above be paid.

What is not included?

  • Talent fee(s) / day rates. These negotiations must be directly with the model or their agency. Those payments are made separately from FuriousFotog. 
  • Be sure to inform the model or agency that they will be shooting for multiple Images so they can price their time accordingly.
  • Associated travel expenses for either Photographer and/or model(s). These are payable in advance of the shoot. These shall include economy class airfare (no basic/discounted fares), lodging, per diem, and car rental fees (if applicable). 
  • Location, permit, and/or rental fees. These costs are the responsibility of the Client. 
  • Commercial rights to sell posters, calendars, etc. See Commercial Product Sales for information on this option.
  • Additional editing (such as that found on Golden Czermak's The Steam Tycoon novel) constitutes high-end retouching services and carries an extra charge. See this section for more.

Other information:

  • A minimum of 30 days notice is required to book a custom photo shoot if specific locations or props are required and there is available time. (Note, FuriousFotog typically books 5  months in advance, especially weekends, so plan accordingly.)
  • Only with Client permission are different poses and/or outfits used for any portfolio work performed after completion of the fully custom cover shoot duties. These separate shots would be made available for further licensing to others by FuriousFotog at the Package A pricing. Client may say no to this for their shoot or allow it, the decision is theirs.
  • The Client is solely responsible for provision and/or confirmation of wardrobe, specific props, locations & associated location/permit fees.
  • Photographer shall work to capture the required poses but is allowed artistic license to ensure the integrity of their work.
  • The Photographer is not responsible for non-approved/mistaken wardrobe or unavailable locations or unruly models. The Photographer is due payment for the time and travel allotted for the session.
  • All photos delivered for a cover are per the Photographer's established editing style. It is up to the cover designer to make adjustments to the cover for your Derivative Work, unless previous arrangements have been made with FuriousFotog to do the design.
  • FuriousFotog is not responsible for another designer's final design.
  • FuriousFotog is not responsible for model behavior or absenteeism.
  • Consult your written Agreement for other terms and conditions (such as image exchanges, etc.).

PACKAGE D, FULL CUSTOM TRIO - $500

This price is for the Photographer's fee only

This can be considered a "Fully Custom Shoot - Lite Edition"

  • Price shown is just for Photographer's session fee.
  • Travel expenses, where applicable, are paid by Client in advance. 
  • Models are booked and paid separately by the Client.

What is included?

  • License for up to 3 custom book cover images.
  • Session fee and license for up to 3 final edited HD images, allowing use of these 3 images in any capacity on up to THREE book covers. There is no additional premium for multiple-book use.
  • Images can also be for promotional materials for "swag" such as postcards, bookmarks, etc. that are given away for free.
  • Other Photographer and model provisions apply as they do in Package C.

ADVERTISING LICENSE

What is it?

Licensing of Image(s) for commercial sale of physical products or services where the Image supports the product, but is not the main selling feature of the product (e.g. a supplement label, an online shirt ad (not the design on the shirt itself), etc.) .

What is required?

  • An Advertising License fee of $250 per Image, per product.
  • For example, if the Image is to be used on a supplement label for a line of protein powders, then the Licensing Fee would be $250 (i.e. $250  x 1).
  • For example, if the Image is to be used on a supplement label for a line of protein powders, BCAAs, and pre-workout, then the Licensing Fee would be $750 (i.e. $250  x 3).
  • For example, if the Image is to be used to advertise 50 different state tee shirt designs online (where the designs are composited over the Image), then the Licensing Fee would be $12,500 (i.e. $250  x 50).

EXTENDED LICENSE

What is it?

  • Licensing of Image(s) for commercial sales of physical products where the main selling point is the Image itself (e.g. the image is featured on calendars, posters, t-shirts, cups, blankets that are sold by the Client).
  • Purchase of this license includes Advertising License conditions.

What is required?

  • Your Standard Image License Agreement allows for use of the Image in any promotional (i.e. FREE) products, swag, and giveaways, along with book teasers, banners, etc.
  • An Extended License fee of 20% of profits is required upon collection of earnings. Most clients build this percentage up front as part of the item's cost.

Stolen Imagery Warning

NOTE: If you see this Image of Jake Wilson on any shirt websites with their own designs photoshopped on, please Contact Me. This image is normally stolen without License Fees for Advertising/Product Promotion paid by the companies using it and my legal team would appreciate the details. Thanks in advance!
