MORE ABOUT "EXCLUSIVITY" AND WHAT IT MEANS

Furious Fotog uses a small, dedicated team of individuals to assess image similarity and will only sell another Image from the same set if it meets the criteria for being different. To determine this, we employ a two-plus factor system that an Image must meet or exceed to remain for sale when it is compared to an Image that has just sold. This means that an Image must have at least TWO differences from the sold Image to remain available, ensuring maintenance of a high level of FuriousFotog® quality.


To assist Clients in making their own informed decisions, when Images are sold they are marked with a "sold" watermark in the gallery and left up so that Clients can see what has sold before making their own call on if something is too similar for their own liking. 


Two-factor evaluation points within a set include but are not limited to:

  • Wearing a different outfit (e.g. a different style of shirt, underwear only, headwear vs. no headwear, etc.)
  • Shooting in a different location (alleyway, street, fields, etc.)
  • Head positioning (looking to the floor, looking to either side, looking skyward, looking at the camera, etc.)
  • Expression/mood (serious, dejected, smiling, etc.)
  • Position of each arm (single arm up, both arms up, both down, tucked behind back, etc.)
  • Position of each hand (in pockets, at the side, in back pockets, grabbing a hat, behind the neck, etc.)
  • Model's stance (standing, seating, crouching, etc).
  • Model's angle (front, 45-degree angle left or right, over-shoulder rear, back shot, etc.)
  • Tattoo visibility (in the shot, blocked, additional artwork, etc.)


IMPORTANT NOTES: 

  • A different set or theme (e.g. Studio vs. Location vs. Cowboy vs. MC, etc.) resets the evaluation criteria because each is considered a group of entirely different images that have new lighting conditions, outfits, props, and/or backgrounds.
  • Because of this, the same pose may appear across multiple sets (e.g. shirtless with an arm up in the studio and on location). If one is purchased, the image(s) in other sets in that same pose will be still available for purchase by others due to those differing lighting conditions, outfits, props, and/or backgrounds.
  • Furious Fotog is only responsible for the integrity of the original Image that is sold from within a set and cannot be responsible for the resulting designs that are created by the Licensee and/or a cover designer (i.e. cropping, editing, styling, etc.), even if the poses from different sets are the same. Issues in this area must be taken up directly with the Licensee and their designer.

ONE MORE REMINDER: Furious Fotog and its team bases its evaluation criteria on the original images that have been photographed within each set. Per the FuriousFotog™ License Agreement the Client signs, they acknowledge that FuriousFotog is not responsible for what is done to the image after it has been purchased by either the Client or another Designer. This includes cropping, digital editing, or other changes performed directly by the Client or a Designer after purchase to achieve their final cover design.
